General Website Terms and Conditions

Effective Date:01/04/2025

Introduction

Welcome to Match Marine Ltd ("Match Marine", "we", "us", or "our"). We operate www.matchmarine.co.uk (the "Website" or "Platform"), a dynamic online marketplace designed to connect individuals and businesses within the marine industry.

By accessing or using the Platform, you agree to be bound by these General Website Terms and Conditions ("Terms"). These Terms govern your general use of the Website and apply to all users, including customers, businesses, and providers of training, activities, and experiences. Additional service-specific terms apply depending on how you engage with the Platform. If you do not agree to these Terms, you must not use the Website.

Who We Are

Match Marine Ltd is a UK-registered company providing a specialised online marketplace designed to connect individuals with businesses in the marine sector. Our mission is to simplify the process of finding and booking marine-related services, whether it be hiring a professional for a specific job, enrolling in a training course, or booking an activity or experience.

As a platform, we facilitate seamless connections between customers and businesses through our reverse marketplace model, where businesses can purchase relevant job leads, as well as our course and experience marketplace, where training providers and activity operators can list and sell their services directly to customers.

We are committed to providing a transparent, efficient, and user-friendly environment, ensuring that businesses can reach the right customers while individuals can easily access the services they need. However, Match Marine acts solely as an intermediary and does not directly provide any of the listed services.

Background Checks

Match Marine Ltd does not conduct background checks, identity verification, or qualification assessments for any users, including businesses, training providers, or clients. We do not verify the accuracy, legitimacy, or completeness of information provided by users, including business credentials, experience levels, or service capabilities.

By using the Platform, users acknowledge and agree that:

  • Match Marine does not endorse, recommend, or guarantee the suitability, competence, or trustworthiness of any user, business, or service provider.
  • Users are solely responsible for conducting their own due diligence before engaging with another user, booking a service, or accepting a job request.
  • Any interactions, agreements, or transactions made through the Platform are at the user’s own risk, and Match Marine assumes no liability for disputes, misrepresentation, or service failures arising from user interactions.

Users are encouraged to exercise caution and discretion when interacting with others on the Platform. If any fraudulent activity, misconduct, or violation of platform policies is suspected, users should report the issue to hello@matchmarine.co.uk. Match Marine reserves the right to restrict or terminate user access if a user is found to be engaging in fraudulent, deceptive, or harmful practices.

Content Backups and Data Integrity

Match Marine Ltd performs regular backups of platform data to maintain security and continuity of service. However, we do not guarantee that backups will always be free from corruption, loss, or errors. Backup failures may occur due to technical malfunctions, corrupted content prior to backup, or data modifications occurring during the backup process.

While we strive to maintain data integrity, users acknowledge that:

  • Match Marine is not responsible for the loss, corruption, or failure to restore content or data.
  • If an issue arises affecting backups, we will provide technical support and troubleshooting assistance, but full data recovery cannot be guaranteed.
  • Users are responsible for maintaining their own records of any important content they upload or share through the Platform.

Prohibited Activities

Users of Match Marine must conduct themselves with honesty, integrity, and professionalism when using the Platform. Any misuse of the Website, whether by businesses, training or activity providers, or customers, is strictly prohibited. Engaging in prohibited activities may result in the removal of content, account suspension or termination, and legal action where applicable.

  • Fraudulent or Misleading Conduct: Users must not engage in any form of fraudulent or deceptive behaviour. This includes posting false or misleading job requests, services, courses, or experience-based activities, as well as misrepresenting business credentials or qualifications. Impersonation of another person, business, or entity, including through the use of false identity details or misleading account information, is strictly prohibited. Additionally, any attempt to manipulate payment processes, such as submitting false refund requests, engaging in chargeback fraud, or misrepresenting the nature of services provided, will be considered a serious violation of these Terms.
  • Circumventing the Platform’s Processes: All communications and transactions between users must take place within the Platform unless expressly permitted otherwise. Users must not attempt to bypass Match Marine’s communication or payment systems to avoid platform fees or commissions. Businesses and training/activity providers must not solicit direct payment from customers outside the authorised payment system (handled by Stripe), and customers must not attempt to arrange services or payments privately to avoid fees. Any off-platform transactions, unless explicitly authorised, may result in account suspension.
  • Unlawful or Unregulated Services: Users must ensure that any service, training, or experience they offer through the Platform complies with all applicable UK laws, regulations, and industry standards. Offering services that require specific licensing, insurance, or accreditation without possessing the necessary authorisations is strictly prohibited. Similarly, any services that present an undue risk to health, safety, or environmental protection must not be listed on the Platform. Match Marine reserves the right to remove any content or listings that fail to comply with legal or regulatory requirements.
  • Abusive or Unethical Behaviour: All interactions on the Platform must be conducted in a respectful and professional manner. Any form of harassment, discrimination, or hate speech is strictly prohibited. Users must not engage in intimidation, bullying, or any conduct that may be deemed abusive, offensive, or harmful to other users. False or defamatory claims about another user, business, training provider, or Match Marine itself will not be tolerated. Additionally, users must ensure that all feedback and reviews are truthful and fair, without personal attacks or unfounded accusations.
  • Spamming, Unsolicited Messaging & Data Misuse: The Platform must not be used for spam, excessive messaging, or unauthorised marketing. Users must not send repetitive or irrelevant messages to other users, nor should they use the Platform’s messaging system to promote unrelated products, services, or external websites. The misuse of customer or business contact details for any purpose other than responding to legitimate inquiries is strictly prohibited. All personal data must be handled in compliance with UK data protection laws, including the UK GDPR.
  • Platform Integrity & Security Violations: Users must not engage in any activities that could compromise the security or functionality of the Platform. Any attempt to hack, scrape, extract data, or gain unauthorised access to the Website or user accounts is strictly prohibited. Uploading or distributing malware, viruses, or any other harmful software that could disrupt the Platform’s operation will result in immediate account suspension and potential legal action. Additionally, users must not attempt to manipulate or artificially influence ratings, rankings, or reviews in any deceptive manner.
  • Non-Payment & Financial Misconduct: Users must honour all payment obligations when using the Platform. Businesses and training/activity providers are required to pay for any leads or services they purchase, and customers must ensure they have sufficient funds available before making a booking. Failure to make payments, repeated late payments, or unjustified disputes may result in account restrictions. Abuse of the payment system, including fraudulent chargebacks, false refund claims, or disputes raised in bad faith, will be treated as financial misconduct and may lead to legal action.
  • Enforcement & Consequences: Match Marine reserves the right to investigate and take action against any breaches of these Terms. Depending on the severity of the violation, we may remove content, issue warnings, suspend or terminate accounts, and pursue legal action where appropriate. Users who are found to have engaged in fraudulent or abusive behaviour may forfeit any outstanding payments or refunds and, where necessary, may be reported to law enforcement or regulatory authorities.

Reviews and Feedback

Match Marine provides a review and feedback system to help maintain transparency, trust, and accountability within the Platform. Users may leave public reviews based on their experiences with businesses, training providers, and customers. Reviews should be honest, factual, and relevant, reflecting genuine interactions.

Users must ensure that their reviews are accurate and based on actual transactions or experiences. Reviews that contain false, misleading, or exaggerated claims may be removed. Users are prohibited from leaving reviews that are unrelated, retaliatory, or intended to unfairly damage the reputation of another user.

Match Marine does not actively moderate reviews but reserves the right to remove any reviews that contain:

  • Profanity or offensive language, including any form of hate speech, racial slurs, or discriminatory remarks.
  • Personal attacks, threats, or defamatory content directed at individuals or businesses.
  • False allegations or misleading statements intended to deceive or manipulate ratings.
  • Confidential or personal information, including email addresses, phone numbers, or payment details.

Users may not engage in review manipulation, including but not limited to:

  • Leaving multiple reviews under different accounts.
  • Offering incentives, discounts, or other benefits in exchange for positive reviews.
  • Posting or soliciting fake reviews, whether positive or negative.

Match Marine operates on a hands-off approach to user-generated reviews, meaning that we do not interfere with the natural flow of feedback unless a review breaches the guidelines outlined above. We do not edit, alter, or verify the accuracy of reviews but may investigate disputes where a review is flagged as potentially violating these Terms.

If a user believes that a review is unfair, misleading, or violates these guidelines, they may report it for review. However, Match Marine does not guarantee the removal of a review unless it is found to breach these Terms.

Match Marine is not responsible for the opinions or statements made in user reviews and does not endorse any feedback left on the Platform. Users acknowledge that reviews reflect the personal experiences of individual users and that Match Marine is not liable for any consequences arising from reviews, including reputational harm or business loss.

Users are encouraged to respond professionally and constructively to reviews, using them as an opportunity to address concerns and improve services where necessary. Businesses and training/activity providers have the option to publicly reply to reviews, provided their responses remain professional and comply with these Terms.

Dispute Resolution Between Users

Match Marine provides a facilitated marketplace where customers, businesses, and training/activity providers can connect, engage, and transact. As an intermediary, Match Marine is not a party to any agreements formed between users and does not assume responsibility for resolving disputes arising from transactions, services, or interactions conducted through the Platform.

Users are expected to make reasonable efforts to resolve disputes directly with the other party involved. This includes addressing concerns through the Platform’s messaging system, discussing any misunderstandings, and seeking amicable solutions before escalating a complaint.

If users are unable to reach a resolution independently, they may report the dispute to Match Marine for review. However, Match Marine’s involvement in dispute resolution is limited and is provided solely as a facilitation service rather than a binding adjudication process.

If an issue cannot be resolved between the parties, users may submit a formal dispute report through the Platform. The report should include:

  • The nature of the dispute, including relevant details and any supporting evidence.
  • A summary of previous attempts to resolve the issue directly.
  • Any proposed resolution or remedial action sought.

Match Marine may review the dispute and provide guidance where appropriate. However, users acknowledge that Match Marine does not act as a legal arbitrator and does not guarantee a specific outcome.

In certain cases, Match Marine may offer informal mediation by facilitating communication between the disputing parties to encourage a resolution. Mediation is purely advisory, and users are not obligated to accept any recommendations made by Match Marine.

Match Marine does not provide refunds, compensation, or financial settlements in disputes unless expressly stated under a separate policy governing refunds or cancellations. Payments made through the Platform are handled via Stripe, and users must adhere to Stripe’s dispute resolution process where applicable.

As a neutral platform, Match Marine is not responsible for:

  • Service quality, completion, or fulfilment of any work, training, or experiences booked through the Platform.
  • Non-payment, delayed payment, or financial disputes between users.
  • Any loss, damage, or inconvenience resulting from disputes between users.

Users agree that Match Marine is not liable for any financial or reputational loss arising from disputes and that all transactions are conducted at their own risk. Users are advised to exercise due diligence before entering into agreements and to seek independent legal advice where necessary.

Intellectual Property

Match Marine Ltd is the sole owner or authorised licensee of all intellectual property associated with the Platform, including but not limited to its website design, branding, trademarks, logos, text, graphics, software, and underlying technology. Users acknowledge that their use of the Platform does not grant them any ownership rights over Match Marine’s intellectual property.

All content made available through the Platform, including but not limited to website materials, proprietary software, and visual elements, is protected by UK copyright, trademark, and intellectual property laws. Users must not copy, modify, distribute, or exploit any part of the Platform’s content without obtaining prior written permission from Match Marine.

Users may submit content to the Platform, including business listings, job descriptions, service descriptions, course details, reviews, messages, and profile information. By submitting content, users grant Match Marine a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable licence to use, display, reproduce, and distribute such content for the purpose of operating and promoting the Platform.

Users must ensure that any content they upload:

  • Is original or properly licensed, meaning they have the right to use and share it.
  • Does not infringe on third-party intellectual property rights, including copyrighted images, text, or trademarks.
  • Is accurate and does not mislead customers, businesses, or training/activity providers.

Match Marine reserves the right to remove or modify any user-generated content that violates these Terms, infringes intellectual property rights, or is deemed inappropriate for the Platform.

Users must not:

  • Use Match Marine’s branding, trademarks, or content for commercial purposes without express written permission.
  • Attempt to replicate, mirror, or create derivative works based on the Platform’s design, structure, or functionality.
  • Use automated tools, bots, or scraping technology to extract data or reproduce Platform content.

Any unauthorised use of Match Marine’s intellectual property may result in legal action, including claims for damages, injunctive relief, and the removal of infringing content.

The Platform may contain third-party content, including trademarks, logos, or services provided by businesses, training providers, or external partners. All third-party intellectual property remains the property of its respective owners, and users may not use, modify, or distribute such content without proper authorisation.

If a user believes that their intellectual property has been used without permission on the Platform, they should contact hello@matchmarine.co.uk with details of the alleged infringement. Match Marine will review such claims and take appropriate action where necessary, including removal of infringing content if required.

Platform Availability

Match Marine aims to provide a reliable and accessible online marketplace; however, we do not guarantee that the Platform will be uninterrupted, error-free, or always available.

We may, from time to time, need to carry out scheduled maintenance, updates, or improvements to enhance Platform functionality and security. Where possible, we will provide advance notice of any planned downtime. However, Match Marine reserves the right to suspend, modify, or discontinue any part of the Platform without prior notice if necessary for operational, security, or regulatory reasons.

While we make reasonable efforts to keep the Platform available, users acknowledge that service interruptions may occur due to factors beyond our control, including but not limited to:

  • Internet disruptions, server failures, or hosting provider issues.
  • Software bugs, cybersecurity threats, or unauthorised access attempts.
  • External factors such as force majeure events, including natural disasters or governmental restrictions.

Match Marine shall not be liable for any temporary or extended service disruptions, data loss, or business impact resulting from platform unavailability. Users are advised to maintain backup copies of any important data they store or share via the Platform.

Match Marine continuously evolves to improve user experience. We reserve the right to add, remove, or modify Platform features, services, or functionalities at our discretion. Such changes may be implemented without prior notice if they are necessary for security, legal compliance, or business operations.

Users acknowledge that their continued use of the Platform after any modifications constitutes acceptance of the updated features and functionalities.

Match Marine does not warrant that access to the Platform will be uninterrupted or free from errors, nor do we guarantee specific performance levels, response times, or service availability percentages. Users acknowledge that occasional downtime, service limitations, or disruptions may occur.

In cases of prolonged service disruptions, users may contact hello@matchmarine.co.uk for assistance, though no compensation or liability will be assumed for business loss, missed opportunities, or service failures caused by temporary unavailability.

Account Termination & Suspension

Match Marine reserves the right to suspend or terminate a user’s account at its discretion if the user engages in any activity that violates these General Website Terms and Conditions, any other Match Marine Terms and Conditions, policies, or any applicable UK laws. Account suspension or termination may occur without prior notice if a user:

  • Violates any Match Marine Terms, Conditions, or Policies, including but not limited to the General Website Terms, Provider Terms, Client Purchase Terms, Lead Generation Terms, or any other agreements governing the use of the Platform.
  • Engages in fraudulent, illegal, or unethical behaviour, such as submitting false information, posting misleading job listings or services, attempting to manipulate search rankings, or circumventing platform rules.
  • Fails to comply with payment obligations, including unauthorised chargebacks, repeated payment disputes, or attempts to process transactions outside of Match Marine’s Stripe Connect system.
  • Attempts to take transactions off-platform, including directing customers, providers, or businesses to complete payments externally in order to avoid platform fees.
  • Posts prohibited, misleading, or inappropriate content, including content that is deceptive, offensive, unlawful, or violates UK consumer protection laws.

  • Fails to adhere to security protocols, including unauthorised access to the Platform, hacking attempts, the use of bots or automated tools, or any actions that compromise the security of Match Marine, its users, or its partners.

If a user’s account is suspended or terminated:

  • They will lose access to their account, including active bookings, purchased leads, messages, and transaction history.
  • Any pending transactions may be cancelled or refunded in accordance with Match Marine’s applicable refund policies.
  • Any violations may be reported to relevant legal or regulatory authorities, including fraud prevention agencies or law enforcement, where applicable.
  • In cases where a provider account is suspended, all current listings may be removed from the Platform.

Match Marine reserves the right to permanently block access to the Platform for users who engage in repeated or serious violations. Users whose accounts have been suspended may submit an appeal by contacting hello@matchmarine.co.uk. However, Match Marine retains full discretion in determining whether an account should be reinstated.

  • Acknowledge that account closure is permanent, and any stored data, including booking history, messages, or listing information, may no longer be accessible after closure.

Limitation of Liability

To the fullest extent permitted by law, Match Marine Ltd, its directors, employees, affiliates, and service providers shall not be liable for any:

  • Loss of profits, revenue, or business opportunities resulting from use or inability to use the Platform.
  • Indirect, incidental, or consequential damages arising from Platform errors, unavailability, or service limitations.
  • Claims related to transactions, services, or agreements between users, including disputes, cancellations, or non-performance.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, or any liability that cannot legally be limited under UK law.

Users agree to indemnify, defend, and hold harmless Match Marine Ltd from and against any claims, damages, liabilities, or expenses (including legal fees) arising from:

  • Breach of these Terms by the user.
  • Misuse of the Platform, including fraudulent listings, data misuse, or unauthorised transactions.
  • Violation of any applicable law, regulation, or third-party rights (including intellectual property, data protection, or contract disputes).
  • Claims made by other users, third parties, or authorities due to actions taken on the Platform.

Match Marine reserves the right to assume exclusive defence and control of any matter subject to indemnification, at the user’s expense. Users agree to cooperate fully in such legal defence, including providing any necessary information or documentation.

Amendments to These Terms

Match Marine reserves the right to update these Terms at any time. Users will be notified of significant changes, and continued use of the Website constitutes acceptance of the updated Terms.

    3. Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or regulatory authority, that provision shall be severed from the remainder of the Terms, which shall remain valid and enforceable to the fullest extent permitted by law. The parties shall make reasonable efforts to replace the invalid provision with a lawful one that closely reflects the original intent.
    4. No Waiver: Failure or delay by Match Marine in enforcing any provision of these Terms shall not constitute a waiver of that provision or any other rights. Any waiver must be expressly made in writing by an authorised representative of Match Marine.
    5. Assignment: Users may not assign, transfer, or delegate any of their rights or obligations under these Terms without prior written consent from Match Marine. Match Marine may freely assign or transfer its rights and obligations under these Terms, including in cases of business sale, merger, or restructuring, without prior notice to users.
    6. Third-Party Rights: Nothing in these Terms shall confer any rights under the Contracts (Rights of Third Parties) Act 1999 on any person who is not a party to these Terms. Only the contracting parties (the user and Match Marine) have the right to enforce or seek remedies under these Terms.
    7. Force Majeure: Match Marine shall not be liable for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government-imposed restrictions, cyberattacks, power outages, technical failures, or third-party service disruptions.
    8. Terms and conditions for clients purchasing courses, experiences, or activities

Effective Date: 01/04/2025

These Terms and Conditions for Clients Purchasing Courses, Experiences, or Activities (“Client Purchase Terms”) govern all bookings made by customers on the Match Marine Ltd platform. These Client Purchase Terms incorporate by reference the General Website Terms and Conditions (“General Terms”). By purchasing a course, experience, or activity through the Platform, clients agree to be bound by both these Client Purchase Terms and the General Terms. In the event of any conflict between these Client Purchase Terms and the General Terms, these Client Purchase Terms shall prevail in relation to course and activity purchases.

Booking and Payment Process

Match Marine provides an online marketplace where customers can browse, book, and pay for marine-related courses, experiences, and activities (collectively, “Services”) offered by independent training providers, experience hosts, and activity organisers (collectively, “Providers”). Customers acknowledge that Match Marine acts solely as a facilitator and is not the provider of any Service listed on the Platform. The contractual relationship for the provision of a booked Service exists exclusively between the customer and the Provider.

To complete a booking, customers must select their desired Service, confirm the details, and proceed with payment through Match Marine’s integrated payment system, which is powered by Stripe Connect. Payment is collected at the time of booking, and a confirmation email will be sent to the customer, serving as proof of purchase. The booking is considered finalised only when full payment has been successfully processed.

Customers acknowledge that all Services are subject to the availability of the Provider. Providers have the right to accept or decline bookings based on availability, minimum participant requirements, or other operational considerations. If a booking cannot be fulfilled, Match Marine will issue a full refund to the customer in accordance with these Terms.

All payments on the Platform are processed exclusively through Stripe Connect, and Match Marine does not process, hold, or distribute funds directly. Upon completion of the booked Service, Stripe transfers the payment to the Provider.

By completing a booking, customers acknowledge that:

  • They are responsible for reviewing all details of the Service before making a purchase, including the Provider’s description, eligibility criteria, and cancellation policies.
  • Payment must be made in full at the time of booking, and no reservations will be confirmed without payment.
  • Once a booking is confirmed, they are subject to Match Marine’s refund and cancellation policies, as well as any additional terms set by the Provider.

Customers who experience technical issues with payments or do not receive a booking confirmation within a reasonable time should contact Match Marine’s support team at hello@matchmarine.co.uk for assistance.

Eligibility to Purchase

Match Marine’s Platform is designed for individuals seeking to book marine-related courses, experiences, and activities. To ensure compliance with UK laws and platform policies, certain eligibility requirements apply to all customers making a purchase.

Customers must be at least 18 years old at the time of booking. Individuals under the age of 18 (“Minors”) may not book Services directly but may participate in activities where permitted, provided that the booking is completed by a parent, legal guardian, or responsible adult on their behalf. The responsible adult making the booking assumes full responsibility for the Minor’s participation, including ensuring compliance with the Provider’s safety requirements, waiver agreements, and any necessary consent forms.

Before making a booking, customers must ensure that they meet all eligibility requirements specified by the Provider, which may include but are not limited to:

  • Skill level or experience requirements (e.g., prior sailing experience for an advanced boating course).
  • Physical fitness or health restrictions (e.g., medical conditions that may prevent safe participation in an activity).
  • Licensing or certification prerequisites (e.g., holding a valid boating licence where required).

Providers retain the right to refuse participation to any customer who does not meet the stated eligibility criteria. If a customer books a Service but is later found to be ineligible to participate, the Provider may refuse entry without refund unless otherwise stated in their listing.

By completing a booking, customers confirm that they:

  • Meet the age and eligibility requirements for the selected Service.
  • Have read and understood the Provider’s terms, policies, and safety requirements before making a purchase.
  • Accept full responsibility for any Minors they book on behalf of and will ensure compliance with all applicable Provider rules.

Customers acknowledge that Match Marine does not verify the eligibility of participants and is not liable for any refusal of service by a Provider due to non-compliance with stated requirements. If a customer is unsure about their eligibility for a specific Service, they are advised to contact the Provider directly before making a booking.

Cancellation and Refund Policy

Match Marine has established a standard cancellation and refund policy in compliance with UK consumer protection laws, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Customers acknowledge that all refunds are subject to the terms outlined below and that Match Marine acts solely as a facilitator, with no responsibility for decisions made by independent providers regarding discretionary refunds.

Customers have the right to cancel their booking for any reason up to 7 days before the start date of the course, experience, or activity and receive a full refund. This cancellation right applies regardless of the reason for cancellation.

For cancellations made within 7 days of the scheduled start date, the decision to issue a refund is at the sole discretion of the provider. Providers may offer a refund up to 48 hours after the completion of the Service, but only if they have specified this option in their listing description. Customers acknowledge that refunds for late cancellations are not guaranteed.

If a refund request is made more than 48 hours after the Service has been completed, Match Marine will not process the refund, and the customer must contact the provider directly, as the funds will have already been transferred to the provider’s account.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, customers who book a Service online may have a 14-day cooling-off period during which they can cancel and receive a full refund.

However, this right does not apply if:

  • The course, experience, or activity is scheduled to take place within those 14 days and
  • The customer has been informed and expressly agreed that they waive their right to cancel upon booking.

Match Marine’s 7-day cancellation policy serves as an extended cooling-off period for customers. Customers acknowledge that by completing a booking, they agree to these cancellation terms and understand that last-minute cancellations may not be eligible for a refund.

If a provider cancels a booking for any reason, Match Marine will issue a full refund to the customer within 14 days in accordance with UK consumer protection laws. Providers acknowledge that repeated cancellations may result in listing removal or account suspension, as such actions negatively impact the Platform’s reliability and customer trust.

Partial refunds are not supported through the Platform. If a customer is dissatisfied with a Service after it has been delivered, they must resolve the issue directly with the provider, as Match Marine is not responsible for service quality or provider-related disputes.

Match Marine reserves the right to issue refunds at its own expense in exceptional cases, such as verified provider misconduct, platform errors, or other extenuating circumstances. This decision is made at Match Marine’s sole discretion and does not establish a precedent for future refund claims.

All refunds issued via the Platform will be processed through Stripe Connect and returned to the customer’s original payment method. Refund processing times may vary depending on the customer’s bank or payment provider. Match Marine is not responsible for third-party payment processing delays.

Complaints Against Providers

Match Marine provides a marketplace platform that connects customers with independent training, experience, and activity providers. Customers acknowledge that Match Marine is not a provider of any service listed on the Platform and does not oversee or control the delivery, quality, or outcome of any course, experience, or activity.

All complaints relating to service quality, safety concerns, provider conduct, or dissatisfaction with a booked Service must be addressed directly with the provider. Customers are encouraged to:

  • Attempt to resolve the issue directly with the provider via Match Marine’s messaging system before, during, or after the booked Service.
  • Review the provider’s stated terms and conditions, including any policies related to refunds, rescheduling, or service guarantees.
  • Submit a complaint to Match Marine only if the provider is suspected of violating Match Marine’s Terms and Conditions (e.g., engaging in fraud, misrepresentation, or misconduct that breaches platform policies).

Match Marine does not mediate individual service disputes or enforce provider commitments beyond ensuring compliance with platform rules. If a complaint does not relate to a breach of Match Marine’s Terms, customers must seek resolution directly with the provider.

If a customer believes a provider has acted dishonestly, misrepresented their service, or engaged in prohibited conduct, they may report the issue to Match Marine at hello@matchmarine.co.uk. Upon receiving a complaint, Match Marine may review the provider’s conduct, and if a breach of platform rules is confirmed, action may be taken, including suspension or removal of the provider’s listing or account.

Customers acknowledge that:

  • Match Marine has no liability for disputes arising from the performance, safety, or satisfaction of a booked Service.
  • Match Marine will not issue refunds based on dissatisfaction alone, as refunds are governed by the platform’s Cancellation and Refund Policy and the provider’s individual terms.
  • Complaints regarding negligence, injury, or potential legal violations should be reported to the relevant regulatory authority or trading standards body in the UK.

Customer Responsibilities

By making a booking through the Match Marine Platform, customers agree to act responsibly, professionally, and in compliance with all applicable policies to ensure a smooth and fair experience for both themselves and the providers. Customers acknowledge that their conduct before, during, and after a booked Service directly impacts the quality and integrity of the Platform.

Customers must ensure that all information provided at the time of booking is accurate and complete, including their name, contact details, and any relevant participant information. Failure to provide correct details may lead to booking issues, refusal of service, or cancellation without refund.

Customers are responsible for reviewing the full details of a course, experience, or activity before completing a purchase, including:

  • Eligibility requirements, such as skill level, physical fitness, or licensing prerequisites.
  • Cancellation and refund policies, as set out by Match Marine and the provider.
  • Any equipment or preparation required, including proper attire, safety gear, or prior certifications.

Upon booking confirmation, customers agree to attend the scheduled course, experience, or activity on time and as prepared as required by the provider. Failure to arrive at the designated time may result in forfeiting the booking without refund unless alternative arrangements are explicitly permitted by the provider.

Customers must comply with all safety instructions, participation guidelines, and provider policies during the course or activity. This includes, but is not limited to:

  • Following all safety briefings, risk disclosures, and operational guidelines provided by the provider.
  • Using any provided equipment responsibly and returning it in the same condition as received.
  • Refraining from disruptive, inappropriate, or unlawful behaviour, including harassment, intoxication, or unsafe actions that may put themselves or others at risk.

Providers retain the right to refuse service, remove a participant, or cancel a booking without refund if a customer fails to comply with provider rules or engages in conduct that is disruptive, unsafe, or in violation of local laws and industry regulations.

Customers are expected to treat providers, staff, and fellow participants with respect and professionalism. Any threatening, discriminatory, or abusive behaviour may result in the immediate removal from the activity without refund, account suspension, or permanent banning from the Platform.

Customers acknowledge that Match Marine is not liable for any incidents, injuries, or disputes arising from a failure to follow provider instructions, safety guidelines, or applicable regulations. Customers participate in activities at their own risk and are encouraged to obtain appropriate personal insurance where necessary.

By booking a Service through the Platform, customers acknowledge that:

  • Match Marine has no involvement in the actual delivery of services and does not guarantee the accuracy of provider listings, descriptions, or qualifications.
  • Customers engage with providers at their own risk and must ensure they meet any eligibility criteria, prerequisites, or safety requirements before participating in an activity.
  • Match Marine does not provide insurance coverage for customers or providers. Customers are encouraged to obtain appropriate personal insurance if participating in activities that carry inherent risks (e.g., water sports, adventure experiences).

Match Marine shall not be liable for any:

  • Injuries, accidents, or harm sustained during participation in a booked course, experience, or activity.
  • Losses, damages, or financial claims arising from cancellations, service failures, or disputes between customers and providers.
  • Dissatisfaction with service quality, instructor performance, or course content.
  • Technical issues, payment processing errors, or third-party service failures (including Stripe Connect).

Customers acknowledge that all liability for service-related claims rests solely with the provider, and Match Marine bears no responsibility for any issues related to bookings, refunds, or service delivery.

Nothing in these Terms shall exclude or limit Match Marine’s liability for: (i) death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any other liability that cannot be excluded or limited under applicable UK law.

Match Marine reserves the right to update or modify these Client Purchase Terms at any time. Terms and Conditions For Clients Posting Job Requests

Effective Date: 01/04/25

These Terms and Conditions for Clients Posting Job Requests (“Client Job Terms”) apply to all users who post job requests on Match Marine Ltd’s platform. These Client Job Terms incorporate by reference the General Website Terms and Conditions (“General Terms”). By posting a job request on the Platform, users agree to be bound by both these Client Job Terms and the General Terms. In the event of any conflict between these Client Job Terms and the General Terms, these Client Job Terms shall prevail in relation to job postings.

Job Posting and Matching Process

Match Marine provides a free job listing service designed to connect clients with businesses operating within the maritime sector. The service functions as an automated matching system, allowing clients to post job requests and be connected with relevant service providers in a structured and efficient manner.

The job posting and matching process operates as follows:

  • Job Submission: Clients submit a job request via the Platform, detailing the type of service required and selecting a location radius within which they are seeking service providers. Clients are encouraged to provide clear, accurate, and comprehensive descriptions to ensure they are matched with the most suitable businesses.
  • Automated Matching: The Platform’s system identifies businesses that operate within the specified location and relevant service category and presents the job request to them. Businesses are notified of new job listings that match their expertise and service area.
  • Business Review & Lead Purchase: Businesses can review job details before making a proposal to a Client. If the Client accepts the proposal and wishes to continue the business may purchase the lead by paying a fixed fee, which grants them access to the Platform’s messaging system, enabling direct communication with the client.
  • Client-Business Interaction: Once a business purchases a lead, the client will be able to communicate with them through the Platform’s messaging system. Clients are free to discuss job details, pricing, timelines, and any other relevant factors with the business before deciding whether to proceed with hiring them.

Clients acknowledge that Match Marine does not control or influence which businesses choose to purchase leads or respond to job requests. The Platform acts solely as a facilitator, and there is no guarantee that a business will engage with or accept a job request. Clients are encouraged to provide clear and well-structured job descriptions to improve their chances of receiving interest from businesses.

Rules for Posting Job Requests

To maintain the integrity and effectiveness of the Platform, clients must ensure that all job requests comply with the following posting rules and guidelines. These rules are designed to promote clarity, fairness, and professionalism, ensuring that businesses can accurately assess and respond to job requests.

  • Be Accurate & Honest: Clients must provide a clear, truthful, and detailed description of the job they require. This includes specifying the type of service, any relevant technical details, and expected timelines. Misleading or vague descriptions may result in reduced responses from businesses or removal of the listing.
  • No Personal Contact Details: To protect user privacy and ensure fair use of the Platform, clients must not include phone numbers, email addresses, or any other direct contact details in job descriptions. Communication should occur exclusively through the Platform’s messaging system until a lead has been unlocked by a business.
  • No Off-Platform Transactions: Clients may not attempt to bypass Match Marine’s system by arranging services or payments directly with businesses before a lead has been purchased. Circumventing the Platform’s process undermines its integrity and may result in account restrictions.
  • Respectful & Professional Language: All job descriptions must be written in clear, professional, and respectful language. Listings containing abusive, discriminatory, or offensive language will be removed, and repeated violations may result in account suspension.
  • Legal & Permitted Work Only: Clients must only post lawful job requests. Jobs that involve illegal, unsafe, or unregulated activities will not be accepted. Where applicable, clients must ensure that their requested work complies with relevant UK laws, maritime safety regulations, and licensing requirements.
  • Real Jobs Only: Job postings must represent genuine work opportunities. Fake, speculative, or misleading job listings are strictly prohibited. Clients who repeatedly post illegitimate job requests may be subject to account suspension.
  • Clear Budget & Expectations: Where applicable, clients should set realistic expectations regarding job scope, budget, and timelines. While businesses are not required to adhere to a listed budget, providing an estimated range can help attract relevant and suitable businesses.
  • No Advertising or Self-Promotion: The job request feature is strictly for connecting clients with service providers. It must not be used for promotional purposes, advertisements, or offering services to businesses. Any misuse of the job posting feature for advertising will result in removal of the listing.
  • No Duplicate Job Listings: Clients must not spam the Platform by posting multiple identical job requests. If a client wishes to repost a job, they must first delete the original listing to avoid unnecessary duplication. Excessive reposting may be considered spam and result in account restrictions.

Match Marine reserves the right to review, modify, or remove any job request that violates these rules or is deemed inappropriate, irrelevant, or misleading. Clients acknowledge that failure to comply with these guidelines may result in account restrictions, listing removal, or suspension from the Platform.

No Obligation to Respond to or Hire a Business

Clients who post job requests on Match Marine’s Platform are under no obligation to hire a business that expresses interest in their job. The Platform serves as a facilitation service, allowing businesses to review and purchase leads at their discretion, but the final decision on whether to proceed with a business remains entirely with the client.

Similarly, businesses are not required to respond to or purchase leads for every job they are matched with. Clients acknowledge that not all job requests will receive responses, as businesses have the freedom to choose which leads they wish to engage with based on availability, scope, budget, and other factors.

If a client does not receive any responses to their job request, they may choose to repost the job. However, they must first delete the original listing to avoid creating duplicate posts. Excessive reposting of the same job request without modification may be considered spam and could result in the listing being removed or account restrictions being applied.

Match Marine does not intervene in the hiring process and does not influence or guarantee business engagement. Clients are encouraged to exercise their own judgment when selecting a business, carefully reviewing responses and discussing job details before entering into an agreement. The Platform merely facilitates connections, and all negotiations, pricing discussions, and service agreements occur directly between the client and the business.

Reporting a Business for Poor Service

Match Marine operates as a neutral facilitator and is not responsible for the quality, reliability, or outcome of services provided by businesses using the Platform. Clients acknowledge that once they engage with a business, any service agreements, pricing arrangements, and work-related matters are solely between the client and the business.

However, if a client believes that a business has engaged in misconduct, unethical behaviour, or has violated Match Marine’s Terms and Conditions, they may submit a report by emailing hello@matchmarine.co.uk. Reports should include:

  • The name of the business and details of the service provided.
  • A clear description of the issue, including any relevant evidence such as messages exchanged or service details.
  • Any attempts made to resolve the issue directly with the business.

Match Marine will review the report only in cases where a business has breached the General Website Terms and Conditions or these Client Job Terms. If a business is found to have engaged in fraudulent, abusive, or prohibited conduct, appropriate action may be taken, which could include temporary suspension or permanent removal from the Platform.

Clients acknowledge that Match Marine does not provide mediation services, financial compensation, or refunds for unsatisfactory work or disputes between clients and businesses. Any contractual disagreements, poor service complaints, or refund claims must be resolved directly with the business.

Match Marine encourages clients to conduct due diligence before engaging with a business, ensuring that terms, pricing, and expectations are clearly discussed before work begins.

Dissatisfaction with Business Matching

Match Marine strives to provide a high-quality matchmaking service, ensuring that job requests are matched with businesses operating within the appropriate category and location radius. However, clients acknowledge that the matching process is automated and based on the details provided in the job request and business profiles.

As the service is provided free of charge, Match Marine bears no liability for any dissatisfaction related to the business matching process, including but not limited to:

  • The number of businesses that express interest in a job request.
  • The suitability, expertise, or qualifications of matched businesses.
  • The pricing, response times, or availability of businesses.
  • Any failure of businesses to engage, respond, or complete work as expected.

Clients are responsible for providing clear, accurate, and detailed job descriptions to improve the quality of matches. If a client feels that the matchmaking process could be improved, they are welcome to submit feedback by emailing hello@matchmarine.co.uk.

While Match Marine does not intervene in individual job matches, we continuously work to refine our matching algorithms to enhance user experience. Client feedback is valuable in helping us improve our services, but Match Marine does not guarantee specific business matches or engagement outcomes.

Restrictions on Job Categories

All job requests posted on Match Marine must be relevant to the maritime sector. The Platform is designed to connect clients with businesses offering marine-related services, and job listings that fall outside of this scope may be removed.

Clients must ensure that their job requests align with the Platform’s intended purpose and do not involve services unrelated to the maritime industry. Acceptable job categories include, but are not limited to:

  • Marine repair and maintenance services (e.g., boat repairs, hull cleaning, engine servicing).
  • Maritime construction and outfitting (e.g., dock building, yacht interiors, marine electrics).
  • Boat transportation and logistics.
  • Diving and underwater services.
  • Maritime safety and compliance inspections.
  • Other professional services within the marine industry.

Match Marine reserves the right to review and remove any job listings that do not meet these criteria or that appear to be misleading, unrelated, or inappropriate for the Platform. Clients attempting to repeatedly post non-compliant job requests may be subject to account suspension or permanent removal from the Platform.

If a client is unsure whether their job request aligns with the Platform’s focus, they may contact hello@matchmarine.co.uk for clarification before posting.

No Endorsement or Verification of Businesses

Match Marine provides a facilitation service only and does not verify, vet, or endorse businesses that use the Platform. Clients acknowledge that:

  • Match Marine does not conduct background checks or confirm the qualifications, licenses, or insurance of businesses.
  • It is the client's responsibility to conduct due diligence before hiring a business, including checking references, certifications, or requesting proof of insurance if required.
  • Match Marine is not liable for any misrepresentation made by businesses regarding their experience, expertise, or service quality.

Clients are encouraged to ask businesses relevant questions and request necessary documentation before engaging their services.

Liability Disclaimer

Match Marine provides the job posting service on an “as-is” and “as available” basis, without any guarantees, warranties, or representations as to its availability, accuracy, or effectiveness. While we facilitate connections between clients and businesses, we do not control, oversee, or regulate the services provided by businesses listed on the Platform.

To the fullest extent permitted by law, Match Marine Ltd and its directors, employees, affiliates, and service providers shall not be liable for:

  • Any failure of businesses to respond, accept, or complete jobs posted by clients.
  • Any losses, damages, injuries, or liabilities arising from the client’s engagement with a business, including but not limited to property damage, financial loss, personal injury, or reputational harm.
  • Any misrepresentation, dishonesty, or misconduct by businesses.
  • Any dispute, cancellation, or dissatisfaction with a business’s services, including failure to meet expectations, delays, pricing disagreements, or poor service quality.
  • Any loss or corruption of data, unauthorised access to accounts, or technical disruptions affecting the availability or operation of the Platform.

Nothing in these Terms shall exclude or limit Match Marine’s liability for: (i) death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any other liability that cannot be excluded or limited under applicable UK law.

Clients acknowledge that they use the Platform at their own risk and are solely responsible for conducting due diligence before engaging with a business. Match Marine does not endorse, verify, or vet businesses listed on the Platform and does not act as an agent, employer, or guarantor of any business.

Amendments to These Terms

Match Marine reserves the right to update or modify these Client Job Terms at any time. Clients will be notified of any material changes, and continued use of the job posting service after any updates constitutes acceptance of the revised Terms. Clients are encouraged to review these Terms periodically to stay informed of any updates.

No verbal or written representations not expressly set out in these Terms shall be binding upon Match Marine.
    2. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of England and Wales. 3. Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or regulatory authority, that provision shall be severed from the remainder of the Terms, which shall remain valid and enforceable to the fullest extent permitted by law. The parties shall negotiate in good faith to replace the invalid provision with a legally valid alternative that closely reflects the original intent.
    4. No Waiver: Failure or delay by Match Marine to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights. Any waiver must be expressly made in writing by an authorised representative of Match Marine.
    5. Assignment: Clients may not transfer, assign, or delegate any of their rights or obligations under these Terms without prior written consent from Match Marine. Match Marine may freely assign or transfer its rights and obligations under these Terms in the event of a business sale, merger, or restructuring.
    6. Third-Party Rights: Nothing in these Terms shall confer any rights under the Contracts (Rights of Third Parties) Act 1999 on any person who is not a party to these Terms. Only the parties to these Terms (the client and Match Marine) have the right to enforce or seek remedies under them.

Terms and Conditions For Businesses Using The Lead Generation Service

Effective Date:01/04/2025

These Terms and Conditions for Businesses Using the Lead Generation Service (“Business Lead Terms”) apply to all businesses that use Match Marine’s lead generation service to connect with potential customers. These Business Lead Terms incorporate by reference the General Website Terms and Conditions (“General Terms”) of Match Marine Ltd. By registering for and using the lead generation service, businesses agree to be bound by both these Business Lead Terms and the General Terms. In the event of any conflict between these Business Lead Terms and the General Terms, these Business Lead Terms shall prevail concerning lead generation services.

Lead Generation Service Overview

Match Marine provides a lead generation service designed to connect businesses operating within the maritime sector with potential customers seeking relevant services. The service functions as a matching system, allowing businesses to identify and engage with prospective clients in a structured and efficient manner.

The lead generation process operates as follows:

  • Job Listings: Customers submit job requests through the Platform, specifying the type of service required and defining a location radius within which they seek service providers.
  • Automated Matching: The Platform uses category-based filtering and geolocation settings to match job requests with businesses operating within the designated area and relevant service category.
  • Lead Review & Purchase: Businesses receive notifications of job requests they have been matched with and can review essential job details before sending a proposal to a customer.
  • Customers then review businesses proposals and can choose whether they want to accept a proposal and reveal their contact details.
  • Unlocking Customer Communication: If a customer accepts a business and a business decides to proceed, they may purchase the lead by paying a fixed fee. Upon payment, the business gains access to the Platform’s messaging system, enabling direct communication with the customer and the exchange of contact details.

Businesses acknowledge that purchasing a lead does not guarantee that the customer will engage their services. The lead fee covers access to the opportunity to communicate with a potential client, and it remains the responsibility of the business to negotiate terms and secure work. Match Marine does not play a role in contractual agreements, pricing negotiations, or the quality assurance of services provided by businesses to customers.

Fees and Payments

Businesses using the lead generation service must pay a fixed fee to access customer job requests and unlock direct communication with potential clients. This fee applies each time a business chooses to purchase a lead, granting access to the Platform’s messaging system, where they can discuss job details and exchange contact information with the customer.

The applicable lead fee will be clearly displayed on the Match Marine Website at the time of purchase. Match Marine reserves the right to adjust the fee structure at any time to reflect market demand, business objectives, or operational costs. Any changes to lead pricing will be communicated in advance, and the updated fees will be reflected on the Website. Businesses acknowledge that continued use of the lead generation service after a pricing adjustment constitutes acceptance of the revised fees.

All fees are exclusive of VAT. Where applicable, Value Added Tax (VAT) will be charged at the prevailing rate in accordance with UK VAT legislation. The VAT amount will be displayed at the point of payment, and businesses are responsible for ensuring they comply with their own VAT registration and reporting obligations.

All payments are non-refundable, including in cases where:

  • The business does not secure work after purchasing a lead.
  • The customer does not respond or chooses another service provider.
  • The business is dissatisfied with the outcome of the engagement.

As businesses have the opportunity to review key details of a job request before purchasing a lead, they assume full responsibility for their decision to proceed with a lead purchase.

All payments must be processed through the Platform’s designated payment provider (Stripe). Businesses agree to:

  • Use only the authorised payment system for all lead transactions.
  • Not attempt to circumvent lead fees by conducting direct transactions with customers outside the Platform.
  • Ensure that all payment details provided are valid and up to date to avoid service disruptions.

Failure to comply with these payment terms, including attempting to bypass the Platform’s payment system, may result in account suspension or termination. Businesses acknowledge that Match Marine is not responsible for any payment processing issues, delays, or disputes arising from transactions handled by third-party payment providers.

Eligibility and Business Requirements

To use the lead generation service, businesses must meet certain eligibility criteria and comply with all applicable UK laws and industry regulations.

Only businesses that operate within the maritime sector or provide marine-related services are permitted to register and participate in the lead generation service. Match Marine reserves the right to determine whether a business meets these criteria and may refuse or revoke access to businesses that do not align with the Platform’s purpose.

Businesses must ensure that all information provided during registration and use of the Platform is accurate, complete, and up to date. This includes, but is not limited to, business name, contact details, service offerings, and (where applicable) company registration number. Providing false, misleading, or outdated information may result in suspension or termination of the account.

All services advertised or provided through the Platform must comply with UK laws, health and safety regulations, and industry-specific licensing requirements where applicable. Businesses offering regulated services must ensure they hold the necessary permits, licences, or insurance required for legal operation.

Match Marine reserves the right to request verification documents from businesses to confirm compliance with these requirements. Failure to provide requested documentation may result in the removal of listings, account suspension, or termination.

No Obligation to Accept Leads

Businesses using the lead generation service are under no obligation to purchase or accept any leads presented to them. The Platform provides businesses with the opportunity to review job details before making a decision, allowing them to assess whether a particular lead aligns with their services, availability, and business preferences.

If a business chooses not to purchase a lead, there are no penalties or restrictions on their continued use of the Platform. Businesses remain free to review and select leads at their discretion, and declining a lead will not impact their ability to receive future matches.

Businesses acknowledge that purchasing a lead does not guarantee work or customer engagement. The lead fee covers access to the opportunity to communicate with a potential client, and the business is responsible for negotiating terms, securing the job, and fulfilling any agreed-upon services.

Match Marine does not interfere in the decision-making process of businesses and does not assign or distribute leads automatically. Businesses retain full autonomy over which leads they choose to engage with, ensuring flexibility and control over their workload.

Lead Expiry and Availability

Match Marine does not guarantee that job leads will remain available indefinitely. Leads may expire or be removed from the Platform after a certain period or if they are no longer relevant. Businesses should review and act on leads in a timely manner, as availability is subject to customer demand and platform activity.

Match Marine reserves the right to limit the number of businesses that can access a particular lead to maintain fair competition and lead quality. Businesses acknowledge that leads are provided on a first-come, first-served basis and that availability is not guaranteed.

Misuse of the Lead Generation Service

Businesses must use the lead generation service in good faith and in accordance with these Terms. Misuse of the service includes, but is not limited to:

  • Repeatedly purchasing leads without genuine intent to engage with customers.
  • Using lead details for purposes other than contacting customers regarding their job requests.
  • Attempting to resell, share, or distribute lead information to third parties.
  • Engaging in misleading or deceptive sales tactics when contacting customers.

Match Marine reserves the right to monitor usage patterns and may suspend or terminate accounts engaging in lead misuse.

Account Suspension and Termination

Match Marine reserves the right to suspend or terminate a business account if it engages in any of the following:

  • Violation of the General Terms or these Business Lead Terms – Breaching any rule outlined in Match Marine’s policies.
  • Fraudulent or Misleading Activity – Providing false business information, engaging in scams, or misrepresenting services.
  • Repeated Negative Reviews & Complaints – Consistently poor service, unresolved disputes, or verified complaints of misconduct.
  • Abusive or Inappropriate Behaviour – Harassing or threatening customers, other businesses, or Match Marine staff.
  • Posting Prohibited Services or Jobs – Attempting to list illegal, unsafe, or non-marine-related services.
  • Spamming or Misuse of the Platform – Sending excessive unsolicited messages or attempting to conduct transactions off-platform to avoid fees.
  • Security Violations – Hacking, attempting to access unauthorised data, or using bots/automated software.
  • Violation of Local Laws or Regulations – Engaging in activities that breach UK laws or industry-specific regulations.
  • Other Conduct That Harms the Platform – Any behaviour that damages Match Marine’s reputation, trust, or business operations.

If an account is suspended or terminated, the business will forfeit any remaining leads or payments and may not be eligible for re-registration.

No Liability for Lead Outcomes

Match Marine acts solely as an intermediary connecting businesses with potential customers and does not guarantee the accuracy, reliability, or success of any lead purchased through the Platform. Businesses acknowledge that the lead generation service is designed to provide opportunities to engage with potential clients, but Match Marine has no control over whether a customer proceeds with a booking, responds to messages, or hires a business after initial contact.

Businesses are responsible for conducting their own due diligence before engaging with customers. This includes verifying job details, assessing customer credibility, and ensuring that the proposed work aligns with their expertise, availability, and business policies.

Match Marine does not:

  • Endorse or verify the legitimacy of job listings posted by customers.
  • Provide any assurances regarding the likelihood of securing work from a purchased lead.
  • Mediate disputes between businesses and customers regarding job terms, payments, or service quality.

Businesses use the lead generation service at their own risk and agree that Match Marine is not liable for:

  • Any financial loss, wasted expenditure, or reputational damage resulting from an unresponsive or uncooperative customer.
  • Any misrepresentation, inaccuracy, or omission in a job request posted by a customer.
  • Any dispute, cancellation, or non-payment between a business and a customer.

Amendments to These Terms

Match Marine reserves the right to modify these Business Lead Terms at any time. Any material changes will be communicated to registered businesses, and continued use of the lead generation service after such changes constitutes acceptance of the revised Terms. Businesses are encouraged to review these Terms periodically to stay informed of any updates.

Terms and Conditions For Training, Experience, And Activity Providers

Effective Date: 01/04/2025

These Terms and Conditions for Training, Experience, and Activity Providers (“Provider Terms”) apply to all businesses or individuals listing and selling courses, experiences, or activity bookings on the Match Marine Ltd platform. These Provider Terms incorporate by reference the General Website Terms and Conditions (“General Terms”). By listing a course, experience, or activity on the Platform, providers agree to be bound by both these Provider Terms and the General Terms. In the event of any conflict between these Provider Terms and the General Terms, these Provider Terms shall prevail with respect to course and activity listings.

Listing and Selling Courses, Experiences, and Activities

Match Marine provides a dedicated marketplace where businesses can list and sell marine-related courses, experiences, and activity bookings (collectively referred to as “Services”). These may include, but are not limited to:

  • Training Courses – Professional qualifications, safety training, and maritime skills development (e.g., sailing certifications, navigation courses, marine first aid).
  • Experiences & Activities – Recreational and adventure-based services (e.g., paddleboarding tours, fishing trips, scuba diving experiences).

Businesses listing Services on the Platform acknowledge that Match Marine acts solely as a facilitator and does not operate, manage, or guarantee the quality or safety of any listed Service. Providers are entirely responsible for ensuring that their Services comply with all applicable UK laws and industry standards.

All Services must be sold exclusively through the Match Marine Platform. Providers are strictly prohibited from:

  • Including external links or contact details in course or activity listings to redirect customers away from the Platform.
  • Attempting to process transactions off-platform in a way that circumvents Match Marine’s payment system.

Listings that violate these rules may be subject to immediate removal, and providers engaging in repeated violations may have their accounts suspended or permanently terminated.

Providers are responsible for ensuring that all information in their listings is accurate, clear, and not misleading. This includes service descriptions, pricing, available dates, duration, and any required qualifications or prerequisites for participation. Customers rely on this information when making a booking, and failure to provide accurate details may result in refund claims, disputes, or listing removal.

Payment Processing

All payments for courses, experiences, and activities listed on the Match Marine Platform are processed exclusively through Stripe Connect, the Platform’s designated third-party payment provider. Providers acknowledge that Match Marine does not process, hold, or distribute funds directly, and all financial transactions are managed by Stripe.

When a customer books a Service, the payment is collected immediately via Stripe Connect and held by Stripe until it is automatically transferred to the provider’s Stripe account, subject to Stripe’s payout schedule and any applicable transaction processing times.

Providers must:

  • Maintain an active and verified Stripe Connect account to receive payments.
  • Ensure that all banking and payment details are up to date to avoid payout delays.

Stripe shall automatically transfer the provider’s payout two days after the completion of the booked activity or experience. Failure to maintain an active Stripe account may result in withheld or delayed payouts until the issue is resolved.

Providers are responsible for setting their own prices for all Services listed on the Platform. Prices must be clearly stated and inclusive of all charges, including any required materials, equipment hire, or applicable taxes.

Match Marine charges a 5% commission on all transactions, which is automatically deducted at the point of payment processing. The platform fee is non-negotiable and non-refundable. Providers acknowledge that this fee covers operational costs, including payment processing fees, platform maintenance, and customer support services. Match Marine reserves the right to adjust the commission rate at any time. Any changes will be communicated in advance, and the updated rate will apply to new bookings from the effective date of the change.

Providers must not:

  • Attempt to circumvent Match Marine’s payment system by requesting or accepting direct payments from customers outside of the Platform.
  • Include external payment links, direct bank transfer requests, or alternative payment methods in listings, customer communications, or marketing materials.
  • Impose additional, undisclosed charges after a booking has been made.

Any provider found engaging in off-platform transactions, payment fraud, or fee avoidance may have their listings removed, payouts withheld, or account suspended.

Match Marine is not responsible for payment processing errors, delays, or account-related issues associated with Stripe. Providers experiencing payment disputes, chargebacks, or technical difficulties must resolve them directly with Stripe’s support team.

In the event of a customer dispute over payment, Match Marine may assist in reviewing transaction details but does not control Stripe’s chargeback or refund processes.

Refund Policy

Match Marine has established a standard refund policy to ensure fairness and compliance with UK consumer protection laws. Providers acknowledge that all refund requests must be handled in accordance with this policy and that they are responsible for clearly communicating any additional refund terms within their service listings.

Customers are entitled to a full refund if they cancel their booking at least 7 days before the start date of the course, experience, or activity. After this 7-day period, refund requests will be at the sole discretion of the provider, who may issue a refund up to 48 hours after the completion of the course or activity. If a provider offers refunds beyond the standard 7-day window, they must clearly outline their specific refund terms within their listing description.

Under UK law, consumers who book services online may have a 14-day cooling-off period to cancel and receive a full refund. However, this right does not apply if the service is scheduled to take place within those 14 days and the customer has been informed that they waive their right to cancel upon booking. Providers must ensure that this is clearly stated in their listing and confirmation emails.

If a provider cancels a course, experience, or activity for any reason, Match Marine will issue a full refund to the customer within 14 days of cancellation, in line with UK consumer protection laws. Providers acknowledge that repeated cancellations may result in listing removal or account suspension, as such actions negatively impact customer trust and the integrity of the Platform.

Partial refunds are not supported through the Platform, meaning that all refunds issued must be for the full amount of the booking. If a customer requests a refund more than 48 hours after the completion of the course or activity, Match Marine will not process the refund, and the customer must contact the provider directly, as the funds will have already been transferred to the provider’s account.

In exceptional circumstances, Match Marine reserves the right to refund customers at its own expense, but this will be done solely at Match Marine’s discretion and will not establish a precedent for future refund requests.

Provider Eligibility and Standards

Providers listing Services on the Platform must:

  • Be legally registered businesses operating within the marine sector.
  • Ensure that they meet all applicable UK laws, industry regulations, and licensing requirements for the Services they provide.
  • Confirm that they have the necessary insurance coverage, professional certifications, and child protection policies (where applicable).
  • Not misrepresent their qualifications, business credentials, or the nature of the Services offered.

Match Marine does not independently verify provider qualifications, insurance coverage, or regulatory compliance. Providers assume full responsibility for ensuring that they are legally compliant before listing their Services.

Provider Responsibilities and Code of Conduct

Providers using the Match Marine Platform must adhere to professional, legal, and ethical standards when listing and delivering services. By listing a course, experience, or activity, providers agree to uphold the integrity of the Platform and maintain a high level of service quality, safety, and customer care.

Providers must ensure that all listings, communications, and services comply with the following requirements:

  • Accuracy and Transparency: Providers must provide accurate, complete, and truthful information in their listings. This includes:
    • Clearly describing the nature, duration, and scope of the course, experience, or activity.
    • Stating any eligibility requirements, prerequisites, or physical fitness levels required for participation.
    • Disclosing any potential risks or safety precautions that customers should be aware of before booking.
    • Including only current and realistic images that genuinely represent the experience offered.
    • Clearly stating refund and cancellation policies in line with Match Marine’s refund terms.

Misleading, exaggerated, or vague descriptions may result in listing removal, customer disputes, and account suspension.

  • Service Fulfilment and Customer Engagement: Providers must honour all confirmed bookings and ensure that services are delivered as described in the listing. Providers agree to:
    • Be punctual and prepared for all scheduled courses or experiences.
    • Ensure that all required equipment, materials, or safety gear are available and in good condition.
    • Maintain professional communication with customers before and after the booking, responding to inquiries in a timely manner.
    • Notify customers as soon as possible in the event of unavoidable cancellations or changes to a booking.

Repeated cancellations, failure to fulfil bookings, or poor customer service may result in listing removal or account suspension.

  • Compliance with UK Laws and Industry Standards: Providers must ensure that they comply with all applicable UK laws, licensing requirements, and industry regulations when delivering their services. This includes, but is not limited to:
    • Health and Safety Compliance: Services must be conducted in accordance with the Health and Safety at Work Act 1974, ensuring that customer safety is prioritised at all times.
    • Licensing and Accreditation: If a course or activity requires a licence, permit, or certification (e.g., RYA accreditation for sailing courses), the provider must hold the necessary qualifications and approvals.
    • Insurance Coverage: Providers must have adequate public liability insurance to cover any risks associated with their services. Proof of insurance may be requested by Match Marine.
    • Child Protection Policies: If the service is open to minors, the provider must comply with the Children Act 1989, ensuring proper safeguarding measures are in place.

Providers are solely responsible for maintaining all necessary permits, licences, and insurance. Match Marine does not verify these credentials and bears no liability for non-compliance.

  • Safety and Risk Management: Providers must ensure that all activities are conducted safely, with appropriate risk assessments in place. Providers agree to:
    • Implement and follow all relevant safety guidelines for their industry.
    • Provide customers with clear instructions and safety briefings before commencing any activity.
    • Use only well-maintained equipment and facilities that meet safety standards.
    • Have an emergency action plan in place, including procedures for medical emergencies, accidents, or adverse weather conditions.

Failure to meet minimum safety standards may result in immediate listing removal and potential legal consequences.

  • Ethical Conduct and Professionalism: Providers must conduct themselves with integrity, professionalism, and respect at all times. This includes:
    • Treating customers, other providers, and Match Marine staff with courtesy and professionalism.
    • Avoiding any form of harassment, discrimination, or offensive behaviour.
    • Maintaining a fair and honest pricing structure and not exploiting customers.
    • Refraining from misleading marketing tactics or attempting to manipulate reviews.

Any reports of abusive behaviour, unethical practices, or customer mistreatment may lead to account suspension or permanent removal from the Platform.

Grounds for Account Suspension or Listing Removal

Match Marine is committed to maintaining a trusted and professional marketplace for customers and providers. To ensure the integrity of the Platform, Match Marine reserves the right to suspend or remove a provider’s account or individual listings if they engage in any activity that violates these Terms, the General Website Terms and Conditions, or applicable UK laws and regulations.

Providers may be subject to account suspension, listing removal, or permanent ban for any of the following reasons:

  • Attempting to direct customers off-platform to complete transactions outside of Match Marine’s payment system. Providers must not include external links, contact details, or alternative payment methods in their listings or communications.
  • Violation of Match Marine’s Terms & Conditions, including failure to adhere to the Platform’s payment policies, refund policies, or content guidelines.
  • Fraudulent or Misleading Activity, such as providing false business information, misrepresenting services, using deceptive marketing practices, or failing to deliver the advertised service.
  • Repeated Negative Reviews & Complaints from customers, particularly where complaints indicate a pattern of poor service, non-fulfilment of bookings, or failure to honour refund policies.
  • Abusive or Inappropriate Behaviour towards customers, other providers, or Match Marine staff. This includes harassment, threats, or any form of discriminatory, offensive, or unprofessional conduct.
  • Posting Prohibited or Unsafe Services that do not align with the maritime sector or that breach UK safety regulations. Providers must ensure that all listed courses, experiences, or activities comply with applicable health and safety laws, licensing requirements, and industry standards.
  • Spamming or Misuse of the Platform, including excessive messaging, the creation of duplicate listings, or the manipulation of reviews or search rankings.
  • Security Violations, such as attempting to gain unauthorised access to other user accounts, using bots or automated tools to manipulate listings, or engaging in any cyber threats that compromise the security of the Platform.
  • Breach of UK Laws or Industry Regulations, including failure to maintain required insurance, permits, or professional accreditations necessary for offering certain services. Providers must ensure that they meet all regulatory and legal requirements before listing a course, experience, or activity.

Match Marine reserves the right to take immediate action against any provider engaging in prohibited activities, including removing listings without prior notice, withholding payouts, suspending accounts, or permanently banning a provider from the Platform.

In cases where a provider disputes an account suspension or listing removal, they may submit an appeal to hello@matchmarine.co.uk, providing any relevant evidence to support their case. However, Match Marine maintains full discretion in determining whether an account or listing should be reinstated.

Amendments to These Terms

Match Marine reserves the right to update or modify these Provider Terms at any time. Providers will be notified of any material changes, and continued use of the Platform after such updates constitutes acceptance of the revised Terms. Providers are encouraged to review these Terms regularly to stay informed of any updates.
